1. Scope & Acceptance of Terms

These Terms & Conditions (“Terms”) apply to all digital products, online courses, coaching programs, masterclasses, templates, downloadable resources, and services (“Products”) offered by Heart & Hustle Co (“we”, “us”, “our”).

By purchasing, accessing, or using any Product, including by completing checkout through platforms such as Stripe, SamCart, Kajabi, or similar providers, you agree to be bound by these Terms.

If you do not agree, you must not purchase or access our Products.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Australian law to purchase or use our Products.

3. Nature of Products (Digital Delivery)

All Products are delivered digitally unless otherwise stated. Access may be provided immediately or within a reasonable time following purchase.

You acknowledge that once access is granted, the Product is considered delivered.

4. Intellectual Property & Licence

All content included in our Products — including but not limited to:

  • videos

  • written materials

  • frameworks, systems, and methods

  • templates and downloads

  • branding, logos, and course structures

is the intellectual property of Heart & Hustle Co.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Product for your personal use or internal business use only.

You must not:

  • share or resell content

  • reproduce or distribute materials

  • provide access to others

  • use content for commercial redistribution

Unauthorised use may result in immediate termination of access without refund and may lead to legal action.

5. AI, Likeness & Content Restrictions

You may not use any content, recordings, images, videos, voice, likeness, or appearance of Heart & Hustle Co or Sophie Deans for:

  • artificial intelligence training

  • voice cloning

  • image or video generation

  • deepfakes or synthetic media

  • AI avatars or automated reproductions

This prohibition applies whether the content is public, private, paid, or free.

Unauthorised use may result in legal action for intellectual property infringement, misrepresentation, and breach of these Terms.

6. Educational Disclaimer

All Products are provided for educational and informational purposes only.

We do not provide:

  • legal advice

  • financial or investment advice

  • tax advice

  • medical or therapeutic advice

You are solely responsible for your decisions, actions, and results.

7. Results, Testimonials & Income Disclaimer

Any testimonials, examples, or income figures shared:

  • reflect individual experiences

  • are not guarantees of results

  • may not be typical

Your outcomes depend on many factors including effort, experience, market conditions, and personal circumstances.

8. Australian Consumer Law (Important)

Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law (ACL).

If a Product is deemed to have a major failure under ACL, you may be entitled to a refund or replacement as required by law.

9. Refund Policy

Except where required by Australian Consumer Law:

  • All sales are final

  • No refunds are provided for change of mind

  • No refunds for lack of use, time constraints, or unmet expectations

  • No refunds once digital access is provided

This policy is consistent with Stripe, SamCart, and Kajabi digital-product standards.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential loss

  • Total liability is limited to the amount paid for the Product

11. Indemnity

You agree to indemnify and hold harmless Heart & Hustle Co and Sophie Deans from any claims, damages, or losses arising from:

  • misuse of Products

  • breach of these Terms

  • infringement caused by your actions

12. Access Suspension or Termination

We reserve the right to suspend or terminate access if you breach these Terms, including misuse or unauthorised sharing.

Termination does not entitle you to a refund.

13. Dispute Resolution

If a dispute arises, both parties agree to attempt to resolve it through good-faith discussion.

If unresolved, disputes will be handled under the laws of Victoria, Australia, and relevant courts or dispute-resolution bodies.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and the Commonwealth of Australia.
